KFC SUMMER COMPETITION

Nov 2024 – Jan 2025

1. The Promoter is Mabilo Investments (Pty) Ltd trading as KFC (“The Promoter”). 

2. The competition is open to all South African Citizens, permanent or temporary Residents above the age of 15 and who are in possession of a valid identity document/ passport/ valid legal permit; except  directors, members, partners, employees, agents or consultants of or any other person who directly or indirectly controls or is controlled by the Promoter or marketing service providers in respect of the promotional competition, or the spouses, life partners, business partners or immediate family members, or anyone who within a period of 183 days preceding this competition has won any competition organised, promoted, or conducted by the Promoter, or who resides at the same address as such a winner, or who uses the same telephone number to enter this competition.

3. This competition is open from 26 November 2024 until 6 January 2025. Any entries received after midnight on the last day will not be valid and not be considered.

4. This competition is only valid at the following KFC stores:

6. To enter, customers can purchase a qualifying meal and provide their cellphone number at the till. A confirmation SMS will be sent to the cellphone number provided to confirm entry into the competition.

7. Qualifying meals include:

a. Promotional Summer Buckets:

i. 9pc Bucket @ R149.90

ii. 15pc Bucket @ R234.90

iii. 21pc Bucket with FREE 1.5l Coke @ R299.90

b. Promotional Summer Twisters:

i. Dunked Twister @ R64.90

ii. Sweet Chilli Cheese Twister @ R64.90

iii. Zinger Jalapeno Twister @ 64.90

iv. Twister Box Meal (with any of the 3 variants) @ R96.90

8. The winners will be selected at random by way of a draw conducted by the Promotor from all entries received. 

9. There are 10 Main Prizes and 350 additional lucky draw prizes.

10. The Main Prize is a 45-Minute Family or Group Photography Session. Terms and Conditions for Main Prize:

a. General

i. This 45-minute family photography session (the “Prize”) is awarded as part of a promotional giveaway by [Photoelements/KFC].

ii. The Prize is non-transferable, non-refundable, and cannot be exchanged for cash or any other service/product.

b. Eligibility and Redemption

i. The Prize is valid for redemption only by the winner as identified in the official prize notification.

ii. The Prize must be redeemed within 6 months from the date of issue. Failure to redeem within this period will result in forfeiture of the Prize.

iii. Redemption is subject to the availability of the Photographer and must be booked at least 2 weeks in advance.

c. Session Details

i. The session is limited to a maximum of 45 minutes and includes 15 fully edited high-resolution digital images, delivered within 14 days of the session.

ii. Including Stretched canvas 600x400mm, and A4 hardcover book with 15 photos including delivery to winner address. Additional images, prints, or services are not included and may be purchased at the Photographer’s standard rates.

iii. The value of the prize including session, Hardcover personal photo book, 600x400 framed canvas, agency fees & delivery is R5000.00 (FIVE THOUSAND RAND ALONE) including Vat.

d. Location and Costs

i. The session will take place in Johannesburg, Pretoria area. The specific location must be agreed upon by both the Photographer and the winner.

ii. Any costs associated with the chosen location (e.g., location hire, permits, or entry fees) are the sole responsibility of the winner.

e. Cancellations and Rescheduling

i. The session cannot be rescheduled for personal convenience. However, rescheduling due to unforeseen circumstances such as illness or weather will be at the Photographer’s sole discretion.

ii. If the Photographer is unable to conduct the session due to unforeseen circumstances, a mutually agreed rescheduling will be arranged. No monetary compensation will be provided.

f. Session Conduct

i. The winner is responsible for ensuring punctuality. Late arrival will reduce the session duration accordingly, with no extensions granted.

ii. The winner is responsible for the conduct of all participants during the session, including minors.

g. Ownership and Usage Rights

i. The Photographer retains copyright and ownership of all images captured during the session.

ii. The winner is granted a personal use license for the delivered images, which includes printing and sharing on social media (with credit to the Photographer).

iii. The winner may not alter, edit, or use the images for commercial purposes without prior written consent from the Photographer.

h. Liability

i. The Photographer is not liable for injuries, accidents, or damages occurring during the session unless caused by negligence.

ii. The Photographer is not responsible for loss or damage to personal belongings brought to the session.

i. Force Majeure

i. The Photographer is not liable for any failure to perform due to unforeseen events such as natural disasters, strikes, or illness. In such cases, the session will be rescheduled.

j. Acceptance of Terms

i. By redeeming the Prize, the winner confirms their understanding and acceptance of these terms and conditions.

11. There will also be a further 350 lucky draw winners who will each receive a KFC voucher (KFC vouchers vary in value):

i. 200x R30 KFC Wicode vouchers

ii. 100x R50 KFC Wicode vouchers

iii. 50x R100 KFC Wicode vouchers

Winners of KFC vouchers are chosen at random by the Promoter periodically during the competition period. KFC voucher winners will receive an SMS with a WICODE that can be redeemed at participating KFC stores as listed in (4). 

12. Winners of the Main Prizes are drawn weekly and will be contacted on the telephone number used to enter the competition.  If, however, they cannot be reached after 6 attempts have been made during business hours within a period of 72 hours for any reason whatsoever, the prize will be forfeited, and another winner will be selected in accordance with the competition rules.

13. Main Prize winners will be required to present the following when collecting their prize:

a. Valid Proof of Identity

b. Valid Proof of Address (required for RICA purposes)

In the case of a winner being younger than 18 years of age, the parent/guardian of the winner will have to provide Proof of Identity and Proof of Address. 

14. All prizes are not exchangeable for cash and not transferable and all winners of the Main Prize will have to claim their prize within 30 days of the draw having taken place in South Africa and at that time identify themselves with a bar coded South African ID book or driver’s licence/ valid passport or permit and sign a receipt for any prize received or provide an address in South Africa or other means whereby the prize can be delivered to them in South Africa, and failure to claim the prize or a refusal or inability to comply herewith will disqualify the winner and a new winner may be drawn in their place at the sole discretion of the Promoter.

15. All risks in the prizes pass to the winner upon notification of having won a prize.  Where necessary, the winner shall ensure that all prizes are insured against all risks including damage to the prize as well as damage to third party property and persons.  Such insurance is for the cost of the winner and neither the Promoter nor any other party associated with the competition will be liable for the costs thereof or be liable should such insurance not be in place.

16. The Promoter shall have the right to terminate the competition immediately and without notice for any reason beyond its control requiring this. In the event of such termination, all participants agree to waive any rights that they may have in terms of this promotion and acknowledge that they will have no recourse against the Promoter, its agents and staff. 

17. All guarantees for any tangible prizes which are won are carried by the manufacturer and or supplier thereof and not by the Promoter who finds the purchase of the prizes but is not the supplier thereof and the Promoter makes no warranties, whether explicit or implied with respect to the prizes.

18.  Participation in the competition constitutes acceptance of the competition rules and entrants agree to abide by the rules.

19. By providing a submission, you warrant that it is your own original work and that you are the owner of any intellectual property therein and grant the Promoter and its affiliated companies the perpetual royalty free right, except where prohibited by law, to use the contents thereof for any purpose whatsoever and to use your name for Competition purposes in promoting or publicising the Competition, including right to name the winner(s) of the prize(s) in public and/or any social media forum. The Promoter, however, does not have any obligation to use the winning entries for any other purpose.

20. Except in so far as is provided for in the Act 68 of 2008, the judges’ decision is final and no correspondence will be entered into.

21. You will be required to provide your full name, age and other related information when entering this Competition. The Promoter and its affiliates will collect and use your personal data listed herein as prescribed in the Protection of Personal Information Act only to enable your participation in this Competition and for online activities related to the Competition. Your personal data will be used to enter you in this Competition and, by participating in the Competition, you consent to the transfer, storage and processing of the data in South Africa, which consent may be withdrawn at any time by written notification to the Promoter. The Promoter shall keep your personal data to fulfil the purposes for which it was collected or as required by applicable laws or regulations. The Promoter will not use your personal data for a different purpose without first obtaining your permission. The Promoter shall not allow third parties to use your personal information. 

22. No images will be taken of the winner to be used for marketing purposes unless express written permission is obtained from the winner beforehand.  Where such permission has been obtained the images will be used only for the purpose as set out in the consent, without any further remuneration being made payable to the winner. All entries become the property of the Promoter. You may withdraw your consent at anytime by completing this form.

23. All entrants indemnify the Promoter, its advertising agencies, advisers, suppliers, and nominated agents against any and all claims, damages or losses resulting from their participation in this Competition arising from negligent acts or omissions of the Promoter.

24. The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of entries. The Promoter is not responsible for any problems or technical malfunction of any telephone network or telephone lines, computer online systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received by the Promoter on account of technical problems, human error or traffic congestion on the internet or at any web site, or any combination thereof, including any injury or damage to your or any other person's computer relating to or resulting from participation in this Competition or downloading any materials in this Competition.
